Terms and Conditions: Power Billing System

1. Introduction

1.1. These terms and conditions govern the use of the power billing system provided by Power Billing System, a company incorporated under the laws, with its principal place of business hereinafter referred to as “we,” “us,” or “our.”

1.2. By using our Service, you agree to abide by these Terms. Please read them carefully before accessing or using the Service.

2. Payment Policy

2.1. Billing Cycle: Customers will be billed on a monthly basis for their power consumption. The billing cycle will start from the date of activation of the Service and will continue until the termination or suspension of the Service.

2.2. Payment Methods: We accept payments through various methods, including but not limited to credit/debit cards, electronic funds transfer (EFT), direct debit, and other approved payment gateways. You are responsible for providing accurate and up-to-date payment information.

2.3. Due Date: Payment for each billing cycle is due within 5 days from the date of the invoice. Failure to pay by the due date may result in late fees or suspension of the Service.

2.4. Late Fees: A late fee of $4.99 may be charged for payments received after the due date. Late fees will accrue daily until the outstanding balance is settled.

2.5. Disputed Charges: If you believe there is an error in the billing statement, you must notify us within 2 days from the invoice date. We will investigate the matter and make necessary adjustments if the error is confirmed. Pending resolution, you are still required to pay undisputed portions of the invoice.

2.6. Currency and Taxes: All prices and charges are in USD, unless otherwise stated. You are responsible for any applicable taxes, duties, or other governmental charges related to the Service.

3. Refund Policy

3.1. Refunds: Refunds are provided in accordance with the following conditions:

a) Overpayment: If you have overpaid your bill, the excess amount will be credited to your account or refunded upon request.

b) Service Disruption: In the event of prolonged service disruption due to our fault, you may be eligible for a refund of the affected period’s charges.

c) Disputed Charges: Refunds will be issued for verified billing errors or discrepancies.

3.2. Refund Process: To request a refund, you must contact our customer support team with the necessary details and documentation. Refunds will be processed within 10 days upon approval.

3.3. Non-Refundable Charges: Certain charges, such as setup fees or administrative charges, are non-refundable unless otherwise stated in writing.

3.4. Refund Limitations: We reserve the right to limit or refuse refunds in cases of abuse, fraud, or violations of these Terms.

4. Termination

4.1. Termination by Customer: You may terminate the Service by providing 7 days written notice. Any outstanding payments or fees must be settled before termination.

4.2. Termination by Us: We reserve the right to terminate or suspend the Service in case of non-payment, violation of these Terms, or for any other valid reason. Prior notice will be given, except in cases of immediate termination due to legal or safety concerns.

4.3. Effect of Termination: Upon termination, you must cease using the Service, and any unpaid charges or fees become immediately due and payable.

5. Limitation of Liability

5.1. We will not be liable for any indirect, incidental, consequential, or punitive damages arising from the use or inability to use the Service, including but not limited to loss of profits, data, or business interruption.

5.2. Our liability for any direct damages arising from the Service is limited to the total amount paid by you for the Service during the 3 months preceding the event giving rise to the claim.

6. Indemnification

6.1. You agree to indemnify, defend, and hold harmless Power Billing System and its affiliates, directors, officers, employees, and agents from any claims, losses, damages, liabilities, or expenses (including legal fees) arising out of or related to your use of the Service, violation of these Terms, or infringement of any third-party rights.

7. Miscellaneous

7.1. Changes to Terms: We reserve the right to modify or update these Terms at any time. Changes will be communicated to you via email or through our website. Continued use of the Service after the effective date of the revised Terms constitutes acceptance of the changes.

7.2. Governing Law: These Terms shall be governed by and construed in accordance with the laws. Any disputes arising under these Terms shall be resolved exclusively in the courts

7.3. Entire Agreement: These Terms constitute the entire agreement between you and us regarding the Service, superseding any prior agreements or understandings.

7.4. Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

By using our Service, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
